CogniFlux Terms of Use

These Terms govern use of the CogniFlux iPhone app and related services provided by Baldwinson Corporation ("we," "us"). By using CogniFlux, you agree to these Terms and to Apple's Standard Licensed Application End User License Agreement, which these Terms supplement. If they conflict for the App Store-distributed app, Apple's Standard EULA controls.
1. The service
CogniFlux is a wellness and education iPhone app. It logs caffeine amounts you enter and creates modeled estimates of caffeine and metabolite levels over time. Estimates are not measurements, medical advice, diagnosis, or treatment, and CogniFlux is not a medical device. Individual response can differ because of health, genetics, pregnancy, medication, smoking, and other factors. Do not use an estimate to make an urgent health or safety decision.
2. Accounts
An account is optional. Email/password, Sign in with Apple, and Google are supported. Core logging works while signed out, and an unsigned-in journal is not uploaded. You are responsible for accurate account information, protecting access to your device and account, and notifying us of suspected unauthorized use.
3. Cloud sync
When you sign in, cloud sync is on by default. You can pause it. Pausing leaves any existing server copy in place until you delete the cloud copy or delete your account. Sync and restore can be delayed or unavailable during network or service failures; keep any records you independently need.
4. HealthKit
With your permission, CogniFlux reads heart rate, resting heart rate, and heart-rate variability from Apple Health for an observational overlay. It does not write caffeine or any other type to Apple Health and does not read sleep analysis. Raw Apple Health samples are not uploaded. CogniFlux does not provide personalized causal conclusions from heart-rate data.
5. Optional network features and diagnostics
The local drink catalog is the default estimator path. If you confirm the just-in-time disclosure, CogniFlux sends the drink description you entered to OpenAI for that estimate. Diagnostics are off by default and use Sentry only after you enable them. There is no research contribution program in version 1.0.
6. Subscriptions
CogniFlux may offer optional auto-renewable Pro subscriptions through Apple's in-app purchase system. The app shows the features, billing period, and current localized price before purchase. Payment is charged to your Apple ID. Your subscription renews automatically unless you cancel through your Apple ID subscription settings before the renewal deadline shown by Apple. Apple manages billing, cancellation, refunds, taxes, price-change consent, and family-sharing availability under its terms. Restore Purchases is available in the app.
Deleting your CogniFlux account or uninstalling the app does not cancel App Store billing. Subscription benefits can change prospectively, but we will not misrepresent the features attached to the purchase you are offered.
7. Acceptable use
You must not misuse the service, interfere with security or availability, access another person's account or data without authorization, reverse engineer the service except where law permits, automate abusive requests, or use CogniFlux unlawfully. You remain responsible for caffeine amounts and other information you enter.
8. Data and privacy
Our Privacy Policy explains what information is handled and how to exercise data choices. You grant us only the limited rights needed to process information you submit to provide, secure, and support the service. You retain your rights in your content.
9. Ownership and license
CogniFlux, its software, design, text, and branding are owned by or licensed to Baldwinson Corporation. Subject to these Terms and Apple's Standard EULA, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app on supported Apple devices for lawful personal use.
10. Availability and changes
We may maintain, secure, modify, suspend, or discontinue parts of the service. We will use reasonable care to avoid unnecessary loss of user-controlled data and provide notice when reasonably possible, but we do not promise uninterrupted or error-free operation. Features that depend on Apple, Google, RevenueCat, Sentry, OpenAI, Resend, network access, or cloud infrastructure may be unavailable when those services fail or change.
11. Account deletion and termination
You may delete your account in the app. This deletes the account and server journal we control; processor records may remain briefly while deletion retries complete, and legally required records may remain. Subscriptions continue until cancelled with Apple. We may suspend or terminate access for material misuse, security risk, legal requirement, or material breach, using notice and recovery where reasonably possible.
12. Disclaimers and liability
To the maximum extent permitted by law, CogniFlux is provided "as is" and "as available" without warranties beyond those that cannot lawfully be excluded. Baldwinson Corporation is not liable for indirect, incidental, special, consequential, or punitive damages, or lost data, profits, or opportunities, arising from use of CogniFlux. Nothing in these Terms excludes liability or consumer rights that applicable law does not allow us to exclude.
13. Governing law
These Terms are governed by California law, excluding conflict-of-law rules, except where the law where you live gives you mandatory rights or requires another forum. You and Baldwinson Corporation agree to try to resolve a dispute through support before filing a claim, without limiting either party's right to urgent relief or a non-waivable remedy.
14. Changes and contact
We may update these Terms to reflect product, legal, or security changes. We will update the effective date and provide additional notice when required. Changes apply prospectively unless law requires otherwise.
