Terms of Service

These Terms of Service ("Terms") govern your use of the Cogniflux mobile application ("the App") provided by Baldwinson Corporation ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Cogniflux, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of Service

Cogniflux is a wellness and educational tool that allows users to log caffeine intake, visualize estimated caffeine and metabolite levels over time, and explore how caffeine timing may relate to sleep, heart rate, and daily performance. The App uses published pharmacokinetic models to generate its estimates. The App may also offer optional sync features that transmit certain data to our servers; these features are disabled by default and require your explicit opt-in.

3. Not Medical Advice

Cogniflux is not a medical device and does not provide medical advice, diagnosis, or treatment. The estimates and visualizations provided by the App are based on population-average pharmacokinetic parameters and are intended for general informational and educational purposes only. Individual caffeine metabolism varies significantly. Always consult a qualified healthcare professional for medical advice.

4. Eligibility

You must be at least 13 years of age (or the applicable minimum age in your jurisdiction) to use Cogniflux. By using the App, you represent that you meet this age requirement.

5. User Responsibilities

You agree to:

• Use the App only for its intended purpose as a personal wellness tool.
• Not attempt to reverse-engineer, decompile, or disassemble the App.
• Not use the App in any way that violates applicable laws or regulations.
• Not redistribute, sublicense, or resell the App or its content.

6. Third-Party Services

Cogniflux integrates with the following third-party services to provide its functionality:

• Apple HealthKit: With your permission, the App may read sleep and heart rate data from, and write caffeine intake data to, Apple HealthKit. HealthKit access is governed by Apple's HealthKit terms and your device permissions. You may revoke access at any time.
• Sentry: The App uses Sentry for crash reporting and error monitoring. Sentry receives only technical diagnostic data and does not receive your caffeine logs or HealthKit data.
• RevenueCat: The App uses RevenueCat for subscription management. RevenueCat processes purchase receipts from Apple to verify your subscription status. RevenueCat does not receive your personal data, caffeine logs, or HealthKit data.
• Baldwinson Corporation Servers: If you enable optional sync features, certain data (including heart rate data) may be transmitted to our private servers. This data is used solely to provide app functionality and is never sold to third parties. You can disable sync or request deletion of your server-side data at any time.

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party service providers.

7. Subscriptions and Payments

Cogniflux may offer premium features available through in-app purchases or subscriptions. By purchasing a subscription, you agree to the following:

• All payments are processed by Apple through the App Store. We do not collect or store your payment information.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription at any time through your App Store account settings.
• Refunds are handled by Apple in accordance with their refund policies.
• Prices are subject to change. Any price increase will take effect at the start of your next billing period following notice.

8. Intellectual Property

All content, design, graphics, code, and other intellectual property in Cogniflux are owned by Baldwinson Corporation and are protected by applicable copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

9. Accuracy of Estimates

The caffeine and metabolite estimates provided by Cogniflux are based on published pharmacokinetic models using population-average parameters. These estimates are illustrative and may not accurately reflect your individual metabolism. Factors including genetics, age, weight, liver function, medications, pregnancy, smoking status, and other variables can significantly affect actual caffeine metabolism. We make no warranties regarding the accuracy of these estimates for any individual user.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Baldwinson Corporation shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. The App is provided "as is" and "as available" without warranties of any kind, either express or implied.

11. Termination

You may stop using Cogniflux at any time by deleting the App from your device. We reserve the right to modify, suspend, or discontinue the App at any time without prior notice.

12. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Effective Date" at the top of this page. Your continued use of Cogniflux after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
